Farmeasy Technologies Private Limited, is a company incorporated under laws of India with its registered office is at Brahma Kutir, House No. 2, Byelane 3, Navagiri Path, Chandmari Guwahati, Assam, 781003 (hereinafter referred to as “Farm Infinity”, “farm∞”, "Company", “Us” or “We”). The Company is the owner of the mobile application and website at www.farminfinity.com, operated under the brand name of ‘Farm Infinity’ (hereinafter collectively referred to as the "Platform"). As a user ("User") of this Platform, the User understands that Farm Infinity provides access to the Users to various financial products, including but not limited to, personal/consumer loans, credit cards, insurance etc., offered by the financial partners of Farm Infinity with a view to facilitate lending and borrowing activities. It is hereby clarified that the term "Users" or “You” used under these Terms & Conditions shall mean any person accessing the Platform merely for browsing or for the purpose of availing product offered by the financial partners of Farm Infinity. This document /agreement/understanding is an electronic record in terms of Information Technology Act, 2000 and is generated by a computer system and does not require any physical or digital signatures. This document is published in accordance with the provisions of Rule 3 of the Information Technology (Intermediaries Guidelines) Rules, 2011. Your use of this Platform implies that You have read, understood and agreed to abide by following, disclaimer, terms & conditions ("Terms & Conditions"). These Terms & Conditions together with our privacy policy as provided on the Platform ("Privacy Policy") govern your usage of the Platform. If You disagree with any part of these Terms & Conditions, please do not use the Platform.
Farm Infinity reserves the right at any time, at its sole discretion, to change or otherwise modify the Terms & Conditions without prior notice, and your continued access or use of the Mobile App/Mobile Site signifies your acceptance of the updated or modified Terms & Conditions. If you object to these Terms & Conditions or any subsequent modifications to these Terms & Conditions or become dissatisfied with the Platform in any way, your only recourse is to immediately terminate use of the same.
1. General
The Platform provides the Users access to various financial
products offered by the financial partners of Farm Infinity. Farm Infinity is
merely a facilitator providing the Platform to any person in need of financial
products and does not directly provide any financial services to the Users.
Farm Infinity is not an organization registered with the Reserve Bank of India
and does not hold any license to engage in any activities relating to lending
or borrowing. Farm Infinity is not a Financial Institution under the Companies
Act, 2013 or the Banking Regulation Act, 1949 or any other laws for the time
being in force in India. Farm Infinity is also not a deposit taking company or
a chit fund or a company offering any investment schemes as per the rules and
regulations for the time being in force in India.
Farm Infinity is a service provider facilitating the provision
of financial products from financial institutions to individuals desirous of
availing such financial products (“Services”). The final decision as regards
lending and borrowing is also subject to the determination of the financial
partner.
In the event You wish to avail any of the products displayed on
the Platform, You will be required to provide certain information and our
representatives will contact You through phone or email to understand your requirements.
For the provision of the Services, Farm Infinity will be using and sharing the information of the User with multiple financial institutions and other parties, as may be required for the purpose mentioned above and Farm Infinity shall also run multiple credit checks to be able to get the best available offers to suit the needs of the Users. The collection, storing, use and transfer of information shared by the User shall be governed in accordance with the Privacy Policy.
2. Eligibility
The User of this Platform unequivocally declares and agrees that the User is a natural / legal person who has attained the age of at least 18 years and is legally allowed to enter into a contract in India. The User is allowed to utilize the Services of Farm Infinity in accordance with the terms and conditions detailed under these Terms & Conditions. By registering on the Platform, the User hereby undertakes to agree and abide by the Terms & Conditions detailed herein. If the User violates any of these Terms & Conditions, or otherwise violates an agreement entered into through the medium of the Platform, Farm Infinity may terminate the User’s membership, delete his/her profile and any content or information posted online by the User on the Platform and / or prohibit the User from using or accessing the Platform at any time in its sole discretion, with or without notice, including without limitation if Farm Infinity determines that the User is under the age of 18 years.
3. Your Account
If You wish to use the Platform, You are required to maintain an
account and will be required to furnish certain information and details,
including Your name, email id, contact number and any other information deemed
necessary by Farm Infinity. You are responsible for maintaining the confidentiality
and security of Your account, password, activities that occur in or through
Your account and for restricting access to Your computer to prevent
unauthorized access to Your account. You agree to accept responsibility for all
activities that occur under Your account or password. You should take all
necessary steps to ensure that the password is kept confidential and secure and
should inform Us immediately if You have any reason to believe that Your
password has become known to anyone else, or if the password is being, or is
likely to be, used in an unauthorized manner. Please ensure that the details
You provide Us with are true, correct, accurate and complete. Upon Farm
Infinity gaining knowledge of having any reasonable suspicion that the
information provided by You is wrong, inaccurate or incorrect, Farm Infinity
shall immediately terminate Your account without any notice to You in this
regard. In the event of any changes to the information shared by You at the
time of registering Yourself on the Platform, You shall be responsible for
forthwith notifying the said changes to Us. You can access and update most of
the information you provided us by logging into the mobile app or by writing to
us at info@farminfinity.com. The
right to use this Platform is personal to the User and is not transferable to
any other person or entity.
You shall, at all times, abide by the Terms & Conditions stated herein and any breach of the same may also lead to Farm Infinity terminating Your account and appropriate civil and criminal remedies will be sought against You as provided under the laws of India.
4. Privacy
Farm Infinity collects certain information from You in order to
provide the Services. Farm Infinity’s use of Your personal information is
governed in accordance with the Privacy Policy located at www.farminfinity.com/Privacy.html
You confirm that all information given to Farm Infinity (whether in Farm Infinity’s online form or otherwise) is true, correct and not misleading. You agree to provide any additional documents to Farm Infinity as may be required from time to time.
5. License and Site Access
Farm Infinity grants You a limited license to access and use the
Platform for availing the Services, but not to download any material from it
(other than page caching) or modify it, or any portion of it. Any unauthorized
access to the Platform or any networks, servers or computer systems connected
to the Platform and any attempt to modify, adapt, translate or reverse engineer
any part of the Platform or re-format or frame any portion of the pages of the
Platform is not permitted. This license is non-transferable and does not permit
any resale or commercial use of this Platform or its contents; any downloading
or copying of account information for the benefit of anyone other than Your
authorized use; or any use of data mining, robots, or similar data gathering
and extraction tools. This Platform or any portion of this Platform (including
but not limited to any copyrighted material, trademarks, or other proprietary
information) may not be reproduced, duplicated, copied, sold, resold, visited,
distributed or otherwise exploited for any commercial purpose. Any unauthorized
use of the Platform shall terminate the permission or revoke the license
granted by Farm Infinity.
Farm Infinity shall at all times have the right to monitor your activities on your account and Platform and shall have the right to terminate your account and the Services in the event of any unauthorized use.
6. Service Termination
Farm Infinity reserves the right to terminate the Services and your use of the Platform at any time without giving notice of termination to You and without any liability towards you. Upon termination, (a) the rights and licenses granted to You in these Terms & Conditions will terminate; and (b) User must stop using the Platform.
7. Limitation of Liability
Notwithstanding anything to the contrary contained under these Terms & Conditions, neither Farm Infinity nor its affiliated companies, subsidiaries, officers, directors, employees or any related party shall have any liability to You or to any third party for any indirect, incidental, special or consequential damages or any loss of revenue or profits arising under or relating to these Terms & Conditions. To the maximum extent permitted by law, You waive, release, discharge and hold harmless Farm Infinity, its affiliated and subsidiary companies, and each of its directors, officers, employees, and agents, from any and all claims, losses, damages, liabilities, expenses and causes of action arising out of Your use of the Platform.
8. Disclaimer
Farm Infinity does not make any representations or warranties on
behalf of the financial service providers, banks or NBFCs partnered with Farm
Infinity with respect to the financial products provided by such partners. Farm
Infinity shall be responsible only to the extent of providing the Services and
all liabilities and obligations with respect to the financial products provided
by the financial partners of Farm Infinity shall be governed by the separate
agreement executed between such financial partners and the Users.
Farm Infinity makes no representations or warranties about the
accuracy, reliability, completeness, current-ness and/or timeliness of any
content, information, software, text, graphics, links or communications
provided on or through the use of the Platform or that the operation of the
Platform will be error free and/or uninterrupted or that the error will be
rectified. The Service is provided on an "as is" and "as
available" basis. Farm Infinity expressly disclaims all warranties of any
kind as to the Service and all information, products and other content
(including that of third parties) included in or accessible from the Service,
whether express or implied, including, but not limited to the implied
warranties of merchantability, fitness for a particular purpose.
Further, Farm Infinity makes no warranties that:
· the Service will meet Your requirements;
· the results that may be obtained from the use of the Service will be accurate or reliable,
· the quality of any products, services, information, or other material purchased or obtained by You through the Service will meet Your expectations.
You are solely responsible for any damage to your computer
system or loss of data that results from the download of any such material. No
advice or information, whether oral or written, obtained by You from Farm
Infinity through or from the Service will create any warranty not expressly
stated in these Terms & Conditions.
This limitation of liability clause shall prevail over any
conflicting or inconsistent provision contained in any of the documents /
content comprising this Terms & Conditions. It is up to You to take
precautions to ensure that whatever You select for Your use is free of such
items as viruses, worms, malware, Trojan horses and other items of a destructive
nature.
9. Indemnity
You agree to indemnify, save, and hold Farm Infinity, its affiliates, contractors, employees, officers, directors, agents and its third party associates, licensors, and partners harmless from any and all claims, demands, losses, damages, and liabilities, costs and expenses, including without limitation legal fees and expenses, arising out of or related to Your use or misuse of the Services or of the Platform, any violation by You of these Terms & Conditions, or any breach of the representations, warranties, and covenants made by You during the creation of Your account or Your infringement of any intellectual property or other right of any person or entity, or as a result of any threatening, libellous, obscene, harassing or offensive material posted/ transmitted by You on the Platform. Farm Infinity reserves the right, at Your expense, to assume the exclusive defence and control of any matter for which You are required to indemnify Farm Infinity, including rights to settle, and You agree to cooperate with Farm Infinity’s defense and settlement of these claims.

change at Farm Infinity’s discretion.
11. Site Management
We reserve the right at our sole discretion, to (1) monitor the
Site for breaches of these Terms and Conditions; (2) take appropriate legal
action against anyone in breach of applicable laws or these Terms and
Conditions; (3) refuse, restrict access to or availability of, or disable (to
the extent technologically feasible) any of your Contributions; (4) remove from
the Site or otherwise disable all files and content that are excessive in size
or are in any way a burden to our systems; and (5) otherwise manage the Site in
a manner designed to protect our rights and property and to facilitate the
proper functioning of the Site and Services. We do not guarantee that the Site
will be secure or free from bugs or viruses. You are responsible for
configuring your information technology, computer programs and platform to
access the Site and you should use your own virus protection software.
12. Modifications
to and availability of the Site
We reserve the right to change, modify, or remove the contents
of the Site at any time or for any reason at our sole discretion without
notice. We also reserve the right to modify or discontinue all or part of the
Services without notice at any time.
We cannot guarantee the Site and Services will be available at
all times. We may experience hardware, software, or other problems or need to
perform maintenance related to the Site, resulting in interruptions, delays, or
errors. You agree that we have no liability whatsoever for any loss, damage, or
inconvenience caused by your inability to access or use the Site or Services
during any downtime or discontinuance of the Site or Services. We are not
obliged to maintain and support the Site or Services or to supply any
corrections, updates, or releases.
There may be information on the Site that contains typographical
errors, inaccuracies, or omissions that may relate to the Services, including
descriptions, pricing, availability, and various other information. We reserve
the right to correct any errors, inaccuracies, or omissions and to change or
update the information at any time, without prior notice.
13. Advertisers/ Third Party Links on the Website
Farm Infinity accepts no responsibility for advertisements contained within the Platform. Farm Infinity has no control over and accepts no responsibility for the content of any website or mobile application to which a link on the Platform exists. Such linked websites and mobile applications are provided “as is” for User’s convenience only with no warranty, express or implied, for the information provided therein. Farm Infinity does not provide any endorsement or recommendation of any third party website or mobile application to which the Platform provides a link.
14. Mobile Application
If you access the Services via a mobile application, then we grant you a revocable, non-exclusive, non-transferable, limited right to install and use the mobile application on wireless electronic devices owned or controlled by you, and to access and use the mobile application on such devices strictly in accordance with the terms and conditions of this license.
The following terms apply when you use a mobile application
obtained from either the Apple Store or Google Play (each an App Distributor)
to access the Services:
(a) The
licence granted to you for our mobile application is limited to a
non-transferable licence to use the application on a device that utilizes the
Apple iOS or Android operating system, as applicable, and in accordance with
the usage rules set forth in the applicable App Distributor terms of service;
(b) We
are responsible for providing any maintenance and support services with respect
to the mobile application as specified in these Terms and Conditions or as
otherwise required under applicable law. You acknowledge that each App
Distributor has no obligation whatsoever to furnish any maintenance and support
services with respect to the mobile application;
(c) In
the event of any failure of the mobile application to conform to any applicable
warranty, you may notify an App Distributor, and the App Distributor, in
accordance with its terms and policies, may refund the purchase price, if any,
paid for the mobile application, and to the maximum extent permitted by
applicable law, an App Distributor will have no other warranty obligation
whatsoever with respect to the mobile application;
(d) You
represent and warrant that (i) you are not located in
a country that is subject to a U.S. government embargo, or that has been
designated by the U.S. government as a “terrorist supporting” country; and (ii)
you are not listed on any U.S. government list of prohibited or restricted
parties;
(e) You
must comply with applicable third party terms of agreement when using the
mobile application, e.g., if you have a VoIP application, then you must not be
in breach of their wireless data service agreement when using the mobile
application; and
(f) You acknowledge and agree that the App Distributors are third party beneficiaries of these Terms and Conditions, and that each App Distributor will have the right (and will be deemed to have accepted the right) to enforce these Terms and Conditions against you as a third party beneficiary thereof.
15. Acknowledgements
You acknowledge that Farm Infinity is a platform solely engaged
in providing services relating to facilitation of provision of financial
services to the Users. Farm Infinity is not engaged in either grant of loan or
any other financial products. You acknowledge that the use of the financial
products is entirely based on the negotiations between You and the financial
partners of Farm Infinity and Farm Infinity or its affiliates, contractors,
employees, officers, directors, agents and its third party associates or
licensors do not have any liabilities with respect to any financial products or
assistance procured or intended to be procured by a User. You acknowledge that
Farm Infinity will not be responsible for any claim or damage in case of use of
the financial products by You. Farm Infinity in no manner warrants or
guarantees the performance of a service provider/financial partner that is
offering the various financial products or services on the Platform.
16. Applicable Law And Dispute Resolution
This Agreement and all other aspects of your use of the Site
shall be governed by and construed in accordance with the laws of India and,
without regard to its conflict of laws rules. You agree that you will notify
Farm Infinity in writing of any claim or dispute concerning or relating to the
Site and the information or services provided through it, and give Farm
Infinity a reasonable period of time to address it BEFORE bringing any legal
action, against Farm Infinity.
17. Other Agreements
This Agreement shall be subject to any other agreements you have
entered into with Farm Infinity.
18. Additional Terms
Certain sections or pages on the Site may contain separate terms
and conditions of use, which are in addition to the terms and conditions of
this Agreement. In the event of a conflict, the additional terms and conditions
will govern for those sections or pages.
19. Copyright Complaints
If you believe, in good faith, that any materials on the Site infringe your copyrights, notifications of claimed copyright infringement should be sent to Farm Infinity’s designated agent. Notification should include:
· an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest;
· a description of the copyrighted work that you claim has been infringed;
· a description of where the material you claim is infringing is located on the Site;
· a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent or the law; and
·
a statement by you, made under penalty of perjury, that the
above information in your notice is accurate and that you are the copyright
owner or duly authorized to act on the copyright owner's behalf.

20. Grievances
